Privacy Policy

1. Controller

MAKUSI REAL ESTATE ΜΟΝΟΠΡΟΣΩΠΗ Ι.Κ.Ε., represented by its managing director Dr. Martin Sbornik, 76 Syngrou Ave., 11742 Athens, Greece · Phone +30 697 216 0484 · E-mail info@makusi-re.com. We have not appointed a data protection officer as we are not required to do so; we answer your requests at the address above.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and Greek Data Protection Law 4624/2019.

2. Hosting and visiting the website

The website, booking system and e-mail accounts are operated by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany (processing on our behalf under Art. 28 GDPR, servers in the EU). When you visit the website, the server processes technically necessary data (IP address, date and time, page requested, browser and operating system) in order to provide the website securely and reliably (Art. 6(1)(f) GDPR). These log data are stored only briefly and then deleted automatically.

Fonts, images and the map are loaded exclusively from our own server. We do not use any analytics, tracking or advertising services and do not embed content from Google, Facebook or other providers.

3. Booking and enquiry

When you book or enquire via the website, we process the information from the form: title, first and last name, date of birth, address, country, e-mail address, phone number, travel dates, number of guests, arrival time, occasion, your message and, for company bookings, company name, address and tax number. The purpose is to handle your booking, perform the rental contract, issue invoices and communicate with you (Art. 6(1)(b) GDPR) and to comply with tax obligations (Art. 6(1)(c) GDPR). Without this information we cannot conclude a contract.

While you fill in the form, a draft is kept only in your browser (session storage) so that no entries are lost; it is deleted when you close the browser.

4. Payment

Online payments (credit card, Apple Pay, Google Pay, PayPal and others) are processed by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. You enter your payment details directly on Stripe's payment page; we do not receive full card or account details, only confirmation of payment. Stripe also processes the data as an independent controller, e.g. for fraud prevention and to comply with legal obligations, and may transfer them to Stripe, Inc. in the USA, which is certified under the EU-US Data Privacy Framework; standard contractual clauses also apply. If you choose PayPal, the payment is additionally processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg. The legal basis is Art. 6(1)(b) GDPR. For bank transfers we process the details on the bank statement (name, IBAN, amount, reference).

5. E-mails

You receive automatic e-mails about your booking: confirmation of receipt and of booking, payment information and reminders, the guest information with the link to the online check-in about one week before arrival and, after departure, a one-time request for a review. The review request is based on our legitimate interest in feedback from our guests (Art. 6(1)(f) GDPR, Art. 11(3) Greek Law 3471/2006); you can object to it at any time by e-mail. We do not send newsletters or advertising. The e-mails are sent via IONOS servers.

6. Online check-in and reporting to the tax authority

For the online check-in we collect the information on the main tenant required by law (name, gender, nationality, date of birth, ID card or passport number, Greek tax number if any, address, phone, expected arrival, emergency contact), the names of the guests travelling with them, photos of the identity documents and, for non-EU citizens, of the visa, as well as your electronic signature of the declaration (Art. 6(1)(b) and (c) GDPR).

Under Greek law (Article 111 of Law 4446/2016 and the decisions of AADE) we must report every stay to the short-term rental register of the Greek tax authority AADE: period, rental price and the tenant's name and tax, ID card or passport number (Art. 6(1)(c) GDPR). We automatically delete the photos of identity and visa documents 30 days after departure.

7. Reviews

If you write a review after your stay, we publish it on the website only with your express consent – with your first name or the name you chose, your country and the month of your stay (Art. 6(1)(a) GDPR). You may withdraw your consent at any time; we will then remove the review. Reviews that guests have published on other platforms are shown only with first name and country.

Reviews are translated automatically into the language of the website. For this, our server sends the title and text of the review – without name, country or other details – to a translation service (DeepL SE, Cologne, Germany; Google Translate of Google LLC, USA; as a fallback MyMemory of Translated S.r.l., Rome, Italy) and stores the translation. No data of website visitors are transmitted, not even their IP address (Art. 6(1)(f) GDPR). “Show original” displays the original text at any time.

8. Calendar synchronisation with Airbnb and Booking.com

To avoid double bookings we exchange only occupied periods with Airbnb and Booking.com – without guests' names or contact details (Art. 6(1)(f) GDPR).

9. Contact by e-mail, phone or WhatsApp

If you contact us, we process your details to answer your request (Art. 6(1)(b) or (f) GDPR). The WhatsApp, Instagram and Google Maps links on the website only become active when clicked; from then on the privacy policy of the respective provider applies (including WhatsApp Ireland Ltd. / Meta).

10. Storage in your browser

We do not use cookies for analytics or advertising. In your browser we store only what is necessary for the website to work: your language, your choice in the cookie notice and the form draft (Art. 4(5) Greek Law 3471/2006, Art. 6(1)(f) GDPR). Should we use statistics or marketing services in future, this will only happen with your consent, which you can withdraw at any time via “Cookie settings” in the footer.

11. Recipients

Your data are received only by those who need them for the respective purpose: our villa manager for your arrival and stay, IONOS (hosting, e-mail), Stripe or PayPal (payment), our tax advisor and public authorities where we are legally obliged (in particular AADE). We do not sell data.

12. Storage period

We keep booking and invoice data for as long as Greek tax and accounting rules require (generally 5 years from the end of the financial year, longer in certain cases) and then delete them. Enquiries and reservations that did not result in a booking are deleted automatically after 12 months. Photos of identity and visa documents are deleted 30 days after departure. Published reviews remain online until you withdraw your consent.

13. Your rights

You have the right of access, rectification, erasure, restriction of processing and data portability (Art. 15–20 GDPR) and the right to withdraw consent with effect for the future. You may object at any time to processing based on legitimate interests (Art. 21 GDPR). Please write to info@makusi-re.com. You also have the right to lodge a complaint with a data protection supervisory authority, in particular the Hellenic Data Protection Authority (Αρχή Προστασίας Δεδομένων Προσωπικού Χαρακτήρα, Kifisias 1–3, 11523 Athens, www.dpa.gr) or the authority in your country of residence.

14. No automated decisions

We do not make solely automated decisions or create profiles within the meaning of Art. 22 GDPR.

Terms and Conditions of Rental

For the rental of Villa AGNES Mykonos · Version: November 2026

1. Landlord and scope

The landlord is MAKUSI REAL ESTATE ΜΟΝΟΠΡΟΣΩΠΗ Ι.Κ.Ε., 76 Syngrou Ave., 11742 Athens, Greece (G.E.MI. 157275201000, VAT EL801457294), represented by its managing director Dr. Martin Sbornik. These terms apply to all bookings of Villa AGNES Mykonos, Choulakia, 84600 Mykonos (short-term rental registration number AMA 00001599775) made directly with us via this website, by e-mail or by phone. For bookings via Airbnb, Booking.com or other platforms, their terms take precedence.

We rent out the furnished villa for temporary holiday use (short-term lease under Article 111 of Greek Law 4446/2016, less than 60 days). This is not a hotel or package travel contract; meals or other tourist services are not included.

2. Booking and conclusion of the contract

The presentation of the villa and its availability on the website is not yet a binding offer. By submitting the booking form you make a binding offer to conclude the rental contract. The contract is concluded:

a) with online payment: when the deposit has been paid successfully; you immediately receive a booking confirmation by e-mail;
b) with payment by bank transfer: when the deposit is received in our account in time. Until then we hold the dates for the period stated in the payment request; if the deposit does not arrive in time, the reservation lapses at no cost to you;
c) with a non-binding enquiry: only with our written confirmation.

The person booking must be of legal age and acts on behalf of all guests travelling with them; they are our contractual partner (main tenant). The contract languages are German, English and Greek.

3. Prices and services

The prices shown at the time of booking apply to the entire villa. They include statutory VAT (currently 13 %), bed linen, bath and pool towels, Wi-Fi, air conditioning, electricity, water and final cleaning. Not included is the state climate resilience fee (τέλος ανθεκτικότητας στην κλιματική κρίση), which we collect on behalf of the Greek state; it is currently €15 per night from April to October and €4 per night from November to March and is payable on site. If the statutory tax or fee changes after booking, the amount required by law applies.

Minimum stay: 3 nights. Maximum occupancy: 10 persons.

4. Payment

A deposit of 25 % of the rental price is due on booking, the balance (75 %) no later than 30 days before arrival. For bookings made less than 30 days before arrival, the full rental price is due immediately. Payment by credit card, Apple Pay, Google Pay, PayPal or other online methods shown (via our payment provider Stripe) or by bank transfer. Bank charges are borne by the guest.

If the balance is not paid by arrival despite a reminder, we may withdraw from the contract after setting a deadline; the cancellation charges under section 6 then apply.

5. Security deposit

A security deposit of €500 in cash is payable on arrival. It is refunded in full on departure after a joint check of the villa, provided no damage, loss or unusual soiling is found; otherwise we deduct the documented costs. If the damage exceeds the deposit, the further claim remains.

6. Cancellation by the guest

You may cancel the contract at any time before arrival. Please notify us in writing (e-mail is sufficient) at info@agnes-mykonos.com; the date of receipt counts. We charge the following cancellation fees, based on the rental price:

· up to 60 days before arrival: 25 % (the deposit)
· 59 to 30 days before arrival: 50 %
· from 29 days before arrival, in case of no-show or early departure: 100 %

You are free to prove that we incurred no loss or a significantly lower loss. If we manage to re-let the villa at the same price, we refund the cancellation fee less the deposit. You may name a substitute tenant who takes over the contract unless we object for good reason. We recommend taking out travel cancellation insurance.

7. No right of withdrawal

For contracts for the provision of holiday accommodation for a specific period there is no statutory right of withdrawal (Greek Law 2251/1994, transposing Article 16(l) of Directive 2011/83/EU). Only the cancellation terms under section 6 apply.

8. Cancellation by the landlord, force majeure

If we are unable to provide the villa for reasons beyond our control (e.g. force majeure, official orders, serious damage to the villa), we refund all payments made promptly and in full. No further claims exist in this case. We may also terminate the contract without notice if the guest seriously breaches these terms or the house rules despite a warning (e.g. over-occupancy, unauthorised events); the rental price is then not refunded.

9. Arrival, departure and online check-in

Check-in from 3 pm, check-out by 11 am; please agree the exact times with our villa manager in advance. Before arrival, the online check-in must be completed with the information required by law and an identity document of the main tenant; under Greek law we must report every stay to the tax authority AADE. Please leave the villa tidy; wash the dishes and dispose of rubbish.

10. Use, guests and house rules

The villa may only be occupied by the persons registered at booking, up to 10. Subletting or letting third parties use the villa is not permitted. Visitors, parties, events and commercial photo or film shoots require our prior written consent. Children aged 6 and over are welcome; parents are responsible for their children. Pets are not allowed.

Smoking inside the house is prohibited. In case of a breach we charge the cost of special cleaning and odour removal, at a flat rate of at least €1,000 per affected room; you are free to prove lower costs. Quiet hours apply from 10 pm. In addition, the house rules in the guest information apply and form part of this contract.

11. Duties and liability of the guest

Please treat the villa and its contents with care and report any damage or defects immediately to our villa manager. The main tenant is liable for damage culpably caused by them, the guests travelling with them or their visitors, and for lost keys, remote controls and access codes.

12. Defects and liability of the landlord

If a defect occurs, please tell us immediately so that we can remedy it; if it is not reported, claims for a price reduction may be lost. We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise our liability is excluded to the extent permitted by law (Article 332 Greek Civil Code). We are liable for valuables and personal belongings only in case of fault; please use the alarm system. Use of the pool, barbecue and outdoor areas is at your own risk; children may only use the pool under constant supervision. Short interruptions of electricity, water or internet caused by utility providers do not give rise to claims.

13. Data protection

How we process your data is explained in our privacy policy.

14. Applicable law, jurisdiction, dispute resolution

Greek law applies. Mandatory consumer protection provisions of your country of residence remain unaffected where applicable. The courts at the location of the villa have jurisdiction for disputes arising from the rental contract (Article 24(1) of Regulation (EU) No 1215/2012). If you have questions or complaints, please contact us directly first – we will gladly find a solution. We are not obliged to take part in dispute resolution proceedings before a consumer arbitration body; consumers may contact the Greek Consumer Ombudsman (Συνήγορος του Καταναλωτή, www.synigoroskatanaloti.gr).

15. Final provisions

Should any provision of these terms be invalid, the remaining provisions remain valid. Deviating agreements must be made in text form (e-mail is sufficient).
